Californians With Cancer File Heartburn Medicine Lawsuits In State Court
Cases in California are being grouped into Judicial Council Coordinated Proceedings (JCCP) similar to Federal MDL
Tuesday, December 28, 2021 - More than 150,000 people alleging Zantac ranitidine caused them to develop heartburn medicine cancer, have registered their intent to file lawsuits in Federal Court multidistrict litigation (MDL). MDL Judge Rosenberg has limited the number of types of cancer that qualify for Zantac lawsuits to bladder cancer and bladder removal, breast cancer, colon cancer, esophageal cancer, kidney cancer, and kidney removal, liver cancer, melanoma, ovarian cancer, prostate cancer, and stomach cancer, according to DrugWatch.com. Given the current MDL schedule, the first Federal trials may not be held until sometime in 2023, more than one year from now. While people identify Zantac heartburn medicine with causing their cancer, it is the raniditine molecule, more specifically, that is the subject of the MDL proceedings. Judge Rosenberg wrote, "This matter concerns the heartburn medication Zantac. More specifically, this matter concerns the ranitidine molecule--the active ingredient of Zantac." It is ranitidine that was the subject of the FDA recall and also the substance tested by online prescription drug testing pharmacy Valisure. The company stumbled on the ranitidine/NDMA problem when one of the founders was asked to prescribe Zantac to his daughter and found levels of N-nitrosdimethylamine (NDMA), "orders of magnitude" greater than the 96 nanograms per capsule that the FDA deems is safe. The 96 NGS may seem small when compared to a hot dog or processed meats, but it is not because Zantac is taken several times per day, day in and day out. Even a slight overage adds up over the years.
Thousands more Zantacr cancer plaintiffs have filed lawsuits in state court in California, Florida, Illinois (Cook County), Minnesota (Minneapolis), New Jersey, New York, Oregon (Portland ), Pennsylvania (Philadelphia), and Washington (Seattle), according to EIN News.com. California has organized their state cases into an MDL group similar to the federal MDL, presided over by Judge Robin Rosenberg in Florida. State court cases will start in October 2022 and jury reactions will be closely monitored. According to EIN, " A California state court judge has scheduled the first Zantac trial to take place on October 10, 2022. While Zantac cases in other jurisdictions may reach trial before the October date, the California Zantac trial is currently the first with established date." The first several California Zantac cancer trials are important to plaintiffs that wish to be compensated for the injuries they have allegedly sustained by taking Zantac heartburn and acid reflux medicine, regularly, repeatedly, and for many years.Experts on the matter think that Sanofi, the maker of Zantac will be forced to offer a generous settlement, much like what has happened to Bayer/Monsanto, the maker of Roundup herbicide with glyphosate. Bayer settled more than 125,000 lawsuits for approximately USD 12 billion after several plaintiffs were awarded more than $100 million each. The Zantac litigation could dwarf that settlement figure since more than 15 million Americans were using Zantac regularly before sales of ranitidine were halted by the US Food and Drug Administration (FDA) on April 1, 2020.
